Elderly Client Services focuses on legal issues affecting older people and their families. It includes Wills, Powers of Attorney, care home fees advice, Court of Protection applications, and Asset Protection planning.
At DMA Law, our Elderly Client Services provide clear, compassionate support on legal matters tied to ageing, health, and finances.
You should make a power of attorney while you still have full mental capacity. This ensures you decide who will make decisions for you if you later lose capacity.
DMA Law helps set up Property and Financial Health and Welfare Affairs LPAs, registered with the Office of the Public Guardian. This goes hand in hand with Will planning and Asset Protection planning
An LPA is made by choice, while deputyship is court-appointed after someone loses capacity. Deputyship involves an application to the Court of Protection, which is slower and more restrictive. Your Deputy would also need to complete comprehensive annual accounts for the Court.
You cannot hide assets, but careful planning can protect your home from unnecessary care fees.
DMA Law advises on Trusts, Asset Protection Wills, and care fee planning. We always comply with Mental Capacity Act 2005 and Care Act 2014 rules to avoid deprivation of assets claims.
Mental capacity is assessed by medical or social care professionals, guided by the Mental Capacity Act 2005.
When capacity is questioned, the Court of Protection makes final decisions if disputes arise. Our Solicitors can also assess capacity, or if they remain uncertain then by a medical or social care professional.
The Court of Protection safeguards adults who lack capacity to manage their affairs.
It appoints deputies, authorises decisions on finances or health, and resolves disputes.
DMA Law’s Court of Protection solicitors help with deputyship applications, Statutory Wills, and complex legal decisions about care and assets.
